1. INTRODUCTION

These Terms & Conditions ("Terms") govern the relationship between:

By placing an order on somanails.com, you agree to be bound by these Terms. If you do not agree, do not use our website.

2. OUR PRODUCTS

We sell manicure and pedicure files and related nail care accessories.

Product descriptions and images on our website are for illustration purposes. Actual products may vary slightly in color or packaging due to manufacturer changes.

We strive for accuracy but do not warrant that product descriptions, colors, or other content on our site are error-free.

3. ELIGIBILITY

To place an order on somanails.com, you must:
- Be at least 18 years old
- Have a valid shipping address in a country we ship to
- Provide accurate, complete, and current information

We reserve the right to refuse or cancel any order for any reason, including:
- Suspected fraud
- Shipping restrictions to your country
- Product unavailability

4. PRICING

All prices on somanails.com are in United States Dollars (USD).

Prices do NOT include:
- Shipping costs (calculated at checkout)
- Customs duties, import taxes, or VAT (see Section 8)
- Any other fees charged by your country's customs

We reserve the right to change prices at any time. Price changes do not affect orders already placed and paid for.

5. ORDER PROCESS

When you place an order:
1. You submit an offer to purchase our products
2. We send an automatic email acknowledging your order
3. We verify payment and product availability
4. We send a second email confirming shipment (this is our acceptance)

A contract between you and us is formed only when we send the shipment confirmation email.

We may cancel your order at any time before shipment for any reason. If we cancel after payment, we will issue a full refund.

6. PAYMENT

We accept payments through Cloud Payments, which supports:
- International credit and debit cards (Visa, Mastercard, American Express)
- Other payment methods offered by Cloud Payments in your region

Payment is due at the time of order.

By providing your payment information, you represent that you are authorized to use that payment method.

We do not store your full payment card details. Cloud Payments handles all payment processing securely.

If your payment is declined, we will not process or ship your order.

7. SHIPPING

7.1. Shipping Origin
All orders ship from: Moscow, Russia

7.2. Shipping Carriers
We use the following carriers:
- DHL Express
- EMS
- Russian Post
- Other transport companies as selected based on destination and package size

7.3. Processing Time
We process orders within 1-3 business days after payment confirmation.
You will receive a shipping confirmation email with a tracking number.

7.4. Delivery Time Estimates

These are estimates only. We are not responsible for delays caused by:
- Customs processing (can take days or weeks)
- Weather conditions
- Carrier strikes or operational issues
- Holidays
- Incorrect address provided by you

7.5. Tracking
Every order includes a tracking number. You can track your package on the carrier's website.
If tracking shows "delivered", we consider the order delivered.

7.6. Failed Delivery
If delivery fails because:
- You were not home to receive the package
- You provided an incorrect address
- You refused to pay customs duties
- You did not pick up from the local post office within the holding period

Then:
- The package may be returned to us
- You will not receive a refund for the original shipping cost
- You may be charged return shipping fees by the carrier
- If you want the order resent, you must pay shipping again

8. CUSTOMS, DUTIES, AND TAXES – VERY IMPORTANT

We ship all orders on a Delivered Duty Unpaid (DDU) basis.

This means:
- Title to the products passes to you in Russia
- You are the importer of record when the package enters your country
- You are solely responsible for:
- All customs duties
- All import taxes (including VAT)
- All customs clearance fees
- Any broker fees charged by the carrier for customs clearance

These fees are NOT included in the price you paid on our website.

We cannot predict what fees your country will charge. Contact your local customs office before ordering for an estimate.

If you refuse to pay customs fees and the package is abandoned or destroyed by customs:
- You will not receive a refund for the products or shipping

By placing an order, you acknowledge and accept these customs responsibilities.

9. TITLE AND RISK OF LOSS

Title to the products passes to you when we hand the package to the carrier in Russia.

Risk of loss passes to you at the same time. This means:
- If the package is lost or damaged in transit, we will assist with a carrier claim
- However, we are not responsible for the package once the carrier accepts it
- If you refuse to accept the package, you remain responsible for the purchase price

We recommend purchasing shipping insurance for valuable orders. Contact us at support@somanails.com for insurance options.

10. RETURNS AND REFUNDS

Please read this section carefully. Due to the hygienic nature of nail care products, returns are limited.

10.1. Conditions for Return – All Regions

You may return a product ONLY if ALL of the following are true:
- The product is UNOPENED
- The product is UNUSED
- The original SEAL is intact
- The original packaging is undamaged
- You contact us within the applicable return period (see Section 10.2)

Opened or used products CANNOT be returned for hygiene reasons. This is consistent with health regulations worldwide for personal care items.

10.2. Return Periods by Region

For EU customers: You have a legal right of withdrawal within 14 days under EU Directive 2011/83/EU. However, this right applies ONLY to unopened, sealed products. Once you open the seal, you lose the right of withdrawal due to hygiene reasons.

10.3. How to Return a Product

Step 1: Contact support@somanails.com within the return period. Include:
- Your order number
- Photos showing the product is unopened and sealed

Step 2: We will provide you with our return address in Russia, Moscow.

Step 3: Ship the product back at your cost (unless defective – see Section 10.6).

Step 4: Once we receive and verify the product is unopened and sealed, we will refund you within 14 days.

10.4. Who Pays for Return Shipping?

For customer-paid returns: Use tracked shipping. We are not responsible for return packages lost in transit.

10.5. Refund Amount

For change-of-mind returns (unopened product):
- We refund: the product price
- We do NOT refund: original shipping cost, return shipping cost

For defective or wrong product:
- We refund: full order total including original shipping

Refunds are processed to the original payment method within 14 days of receiving the returned product.

10.6. Defective or Damaged Products

If you receive a product with a manufacturing defect or shipping damage:

Contact us within 7 days of delivery at support@somanails.com with:
- Your order number
- Clear photos or video showing the defect
- Description of the issue

If we confirm the product is defective:
- We will provide a return shipping label (at our cost)
- We will send a free replacement OR issue a full refund (your choice)

The following are NOT considered defects:
- Normal minor variations in color or texture
- Damage caused by misuse or improper storage
- Discomfort, allergic reaction, or skin sensitivity – always test on a small area first if you have sensitive skin

10.7. Non-Returnable Items

The following cannot be returned for any reason (except manufacturing defect):
- Products with broken or tampered seals
- Products that have been used or opened
- Products damaged by customer after delivery
- Custom or personalized orders (if offered)

11. VIDEO PACKAGING VERIFICATION

We video-record the packaging process for all orders. A sticker on your package states:

"Packaging video-recorded – opening this package constitutes acceptance of contents as delivered."

By opening the package, you agree that:
- You have inspected the outer packaging for damage before opening
- The video recording serves as evidence of proper packing
- Any claims of missing or wrong items must be supported by your own unboxing video

This protects both you and us against fraud or shipping disputes.

12. NO MEDICAL CLAIMS

Our products are cosmetic/nail care tools. They are not medical devices.

We do not claim that our products diagnose, treat, cure, or prevent any medical condition, including nail fungus, infections, or skin diseases.

If you have a medical condition affecting your nails or skin, consult a doctor before using our products.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

- Our total liability for any claim arising from your purchase is limited to the price you paid for the product(s)
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not liable for lost profits, lost revenue, or lost data
- We are not liable for any allergic reactions, skin irritations, or infections

Some countries do not allow limitation of liability for personal injury or consumer claims. If you are in such a country (e.g., certain EU member states), these limitations apply only to the extent permitted by your local law.

14. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your misuse of our products
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Your failure to pay customs duties or taxes

15. GOVERNING LAW

These Terms are governed by the laws of the Russian Federation, without regard to conflict of law principles.

For EU customers: This does not deprive you of mandatory consumer protection rights under the laws of your country of residence.

16. DISPUTE RESOLUTION

If you have a complaint:
1. Contact us at support@somanails.com – we will attempt to resolve the dispute within 30 days
2. If unresolved, you may file a claim in the courts of Moscow, Russia

For EU customers: You may also use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

We do not participate in consumer arbitration board proceedings.

17. FORCE MAJEURE

We are not liable for delays or failures to perform due to causes beyond our reasonable control, including:
- War, invasion, or armed conflict
- Sanctions or trade restrictions
- Natural disasters
- Pandemics, epidemics, or government quarantine orders
- Postal strikes or carrier failures
- Customs seizures or delays

If a force majeure event occurs, we will:
- Notify you as soon as reasonably possible
- Suspend performance until the event ends
- Offer a full refund for undelivered orders if the delay exceeds 60 days

18. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and us regarding your purchase. They supersede any prior agreements or communications.

20. AMENDMENTS

We may amend these Terms at any time by posting the amended version on this page. The "Last updated" date will change.

Amendments apply to orders placed after the amendment date. Orders placed before an amendment are governed by the Terms in effect at the time of the order.
